1. Acceptance of Terms

By accessing or using the EazyMail application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.

These Terms constitute a legally binding agreement between you and EazyMail ("we," "us," or "our") regarding your use of the App. You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Service Description

EazyMail is an application that integrates with Gmail to provide an enhanced email management experience. Our App allows you to read, send, and receive emails through your existing Gmail account with improved organization and user interface features.

3. User Accounts and Gmail API Access

To use EazyMail, you must have a valid Gmail account and grant our App permission to access certain Gmail data through Google's OAuth 2.0 authentication process. The specific permissions we request are:

• Read your email messages and settings - This allows EazyMail to display your emails and customize your experience based on your Gmail settings.
• Send email on your behalf - This allows you to compose and send emails through our interface.
• Manage your mail - This allows you to manage your emails through our interface.

You may revoke these permissions at any time by visiting your Google Account Permissions page.

You are responsible for maintaining the confidentiality of your Google account credentials. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Data Usage and Scope of Gmail Access

Our use of Gmail API services adheres strictly to the Google API Services User Data Policy. Specifically:

• We access your Gmail data only to provide or improve user-facing features that are prominent and directly relevant to the app's functionality.
• We do not use Gmail data for serving advertisements.
• We do not sell or share your Gmail data with third parties except as necessary to provide and improve the App's features.
• Human access to your Gmail data is limited to specific cases such as responding to your support requests, troubleshooting, or complying with applicable laws.
• Our App undergoes regular security assessments to ensure the safety of your data.

We request and use the minimum scopes necessary to provide our service functionality:

• https://www.googleapis.com/auth/gmail.readonly - To read and display your emails
• https://www.googleapis.com/auth/gmail.send - To send emails on your behalf
• https://www.googleapis.com/auth/gmail.modify - To Read, Compose and Send emails

5. License and Usage Rights

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal or business use on devices that you own or control.

This license does not grant you any right to:

• Copy, modify, or create derivative works of the App
• Distribute, transfer, sublicense, lease, lend, or rent the App to any third party
• Reverse engineer, decompile, or disassemble the App
• Use the App in violation of applicable laws or regulations

6. Restrictions on Use

You agree not to use the App to:

• Violate any applicable laws, regulations, or third-party rights
• Send unsolicited or unauthorized advertising, promotional materials, spam, or any other form of unwanted solicitation
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
• Interfere with or disrupt the integrity or performance of the App or third-party networks or services
• Attempt to gain unauthorized access to the App, user accounts, or related systems
• Use any automated process or service to access or use the service
• Introduce any malware, viruses, or other harmful code into the App or any connected systems

7. Privacy and Data Protection

Our privacy practices are described in our Privacy Policy, which is incorporated into these Terms. By using the App, you agree to our collection, use, and disclosure practices as described in the Privacy Policy.

We are committed to protecting your privacy and the security of your personal information. We implement appropriate technical and organizational measures to protect your data against unauthorized or unlawful processing and against accidental loss, destruction, or damage.

8. Security Measures

We implement and maintain reasonable security measures to protect your data:

9. Disclaimers and Warranties

The app is provided "as is" and "as available," without warranty of any kind, either express or implied. To the maximum extent permitted by applicable law, we explicitly disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will function uninterrupted, error-free, or that defects will be corrected. We make no warranty regarding the reliability, accuracy, or completeness of the app.

You understand and agree that your use of the app is at your own risk. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall we, our affiliates, directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential damages, or any damages whatsoever, including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the app
• Any conduct or content of any third party on the app
• Any content obtained from the app
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for any claim arising from or relating to these terms or the app shall not exceed the amount paid by you to us for the app during the twelve (12) months prior to such claim.

Some jurisdictions do not allow the limitation of liability, so the above limitations may not apply to you.

11. Termination

We may suspend or terminate your access to the App at any time for any reason, including if you violate these Terms.

You may terminate these Terms at any time by:

• Uninstalling the App from your device
• Revoking the App's access to your Gmail account through your Google Account Permissions page

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of significant changes to the Terms by posting a notice on our website or through the App. Your continued use of the App after such modifications will constitute your acknowledgment and acceptance of the modified Terms.

We encourage you to periodically review the Terms to stay informed about our service provisions and guidelines.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in the United States, and you consent to the personal jurisdiction therein.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
